WHO IS IT FOR?

For established e-Commerce businesses who are selling online to consumers in the EU and want to ensure compliance with recent EU e-Commerce, Consumer law changes, and Data Protection laws.

SCOPE

An audit of, and detailed gap analysis of your Terms and Policies and website to check whether it complies with EU e-Commerce and Consumer Laws. You will receive our tailored recommendations to close all identified gaps.

WHY IS IT NEEDED?

EU e-Commerce laws and Consumer laws have been evolving fast in the last 5 years, more is coming, and the EU regulatory framework is now extensive and complex. As a successful business, you need to ensure that your website/platform, online practices, terms and policies are up-to-date and remain in compliance with e-Commerce and Consumer laws. If you get it wrong, you could face regulatory and reputational problems which may negatively impact your e-Commerce business. Our e-Com Advanced Compliance Pack provides you with a legal health-check of your online business through our proprietary gap analysis tool and gives you clear recommendations on how to close the gaps that have resulted from changes in law.

WHAT’S INCLUDED?

1. KICK-OFF MEETINGS

Kick-off meetings with an experienced e-Commerce lawyer to discuss your business and answer your questions. You may have up to two meetings of one-hour duration.

2. E-COM/CONSUMER LAW CHECKLIST

We will provide you with a checklist of the EU e-Commerce and Consumer laws applicable to your business.

3. GAP ANALYSIS

Based on the e-Com/Consumer Checklist, we will perform a gap analysis to assess whether your Terms and Policies and the customer journey on your website comply with applicable EU e-Commerce and Consumer Laws. We will:

explain and discuss the gap analysis tool with you.

provide you with the results of the gap analysis.

provide you with recommendations on how to fix any gaps based on applicable law and best practices.

4. ONGOING REVIEW MEETINGS

You can book additional review meetings of up to two hours in duration to discuss the progress of the gap analysis and deliverables, and to ask any questions.

5. FINAL REVIEW/DISCUSSION OF RESULTS

You will have a final review meeting of up to two hours to discuss the gap analysis, our practical recommendations, and to answer your questions.

6. ONGOING SUPPORT

For 12-months following the e-Com Advanced Pack start date, you may ask questions about your Gap Analysis and the e-Com/Consumer Checklist of the applicable EU e-Commerce and Consumer laws. Questions and answers are by email.

UK and EU Representative Services for General Data Processing Regulation (GDPR) Compliance
All companies without offices in the UK or in any EU member states must appoint an EU representative under the General Data Protection Regulation (GDPR) if it:

The EU/UK Representative acts as a local contact for data subjects and supervisory authorities in relation to issues arising from the processing of personal data. We provide you peace of mind by providing you with an experienced data protection representative. Our services cover all legal requirements of article 27 of the GDPR and the UK GDPR including personal support, and a direct contact for data subjects and for enquiries from data protection supervisory authorities.

DSA EU Representative and Point of Contact
In February 2024, if your business is providing services to EU consumers as an intermediary, internet, cloud, hosting service provider, or an online marketplace, app store, social media platform or search engine, you will be required to have a legal representative and point of contact under the EU’s Digital Services Act.
